Keller Postman has been named the Privacy & Data Breach Law Firm of the Year by the National Law Journal at the 2022 Elite Trial Lawyers Awards.
Keller Postman earned this prestigious recognition as a result of one of the firm’s largest pursuits of mass arbitration to date against Amazon on behalf of more than 75,000 Amazon Alexa users who were recorded without permission. Faced with the burden of arbitrating so many individuals’ claims at once, in May 2021, Amazon changed its terms of service to eliminate its arbitration clause altogether, allowing consumers (for the first time) to pursue their rights in court.
“This is one of the first times we’ve applied our arbitration strategy against a company for privacy-related violations,” Managing Partner Warren Postman said. “Our lives are increasingly powered by technology. And as companies test boundaries, they lean on arbitration clauses to protect them from liability. We’re here to defend consumers from privacy violations, arbitration clause or not.”
Keller Postman’s broader privacy practice is also helping to shape an important and dynamic legal landscape. The firm represents the State of Texas in a lawsuit against Facebook parent Meta Platforms Inc. for its decade-long use of facial-recognition technology to exploit the biometric identifiers of tens of millions of Americans in violation of Texas law. The suit—State of Texas v. Meta Platforms LLC—seeks civil penalties in the hundreds of billions of dollars making it one of the most high-stakes privacy-related matters in the country.
Keller Postman also represents thousands of individuals who assert Biometric Information Privacy Act (BIPA) claims in Illinois and has filed over 20 data breach class actions against entities who failed to protect their customers’ information.
The award was announced at the Elite Trial Lawyers awards ceremony yesterday on July 14. Keller Postman Partner Zina Bash was also honored as one of the 2022 Elite Women of the Plaintiffs’ Bar. And Partner Seth Meyer, along with Associates Brooke Clason Smith and Albert Pak, were honored as 2022 Rising Stars of the Plaintiffs’ Bar.
