The American Lawyer Names Keller Postman Partner Ben Whiting to 2022 Midwest Lawyers Trailblazers

Keller Postman LLC Partner Ben Whiting has been named to The American Lawyer’s 2022 Midwest Trailblazers. Now in its second year of production, the list recognizes professionals in the Midwest who “have moved the needle in the legal industry.”

Based in Keller Postman’s Chicago office, Ben has led the development of strategy on multiple campaigns for Keller Postman’s revolutionary mass-arbitration practice, turning the tables on corporations that use arbitration clauses as a liability shield. Leaning on a trial-based approached learned from his decade of defense-side experience, he has helped to influence successful resolutions for more than 500,000 clients to date.

“As first movers in the new and growing field of mass arbitrations, our firm is creating from scratch the legal and logistic strategies necessary to secure justice for our many clients across many individual arbitrations simultaneously,” Ben wrote in his 2022 Midwest Trailblazers Q&A. “By drawing on my experience defending corporations in high-stakes arbitrations and trials, and relying on an empowered and entrepreneurial team dedicated to helping our clients, I have helped shape the firm’s litigation and operational strategy in these mass arbitrations.”

Most notably, Ben recently led individual arbitrations for approximately 200,000 Intuit customers who were tricked into paying to file their taxes through TurboTax (when eligible to file for free). He managed overall strategy, both at a programmatic level and through overseeing thousands of individual arbitrations.

In addition to this work, Ben also leads the litigation on behalf of more than 2,500 individuals against violators of Illinois’ Biometric Information Privacy Act (BIPA), shaping an important and dynamic legal landscape.
